A violência obstétrica é uma forma de abuso praticado em gestantes nas unidades de saúde durante a gravidez, sendo um grave problema de saúde pública. Neste sentido, o objetivo do estudo é analisar as normas positivadas no nosso ordenamento jurídico, identificar os atos de violência obstétrica, os meios de prevenção e as medidas judiciais pertinentes, além de analisar as decisões mais recente do judiciário sobre violência obstétrica no pré-parto, parto e pós-parto. Sendo assim, esse artigo de revisão bibliográfica e jurídica busca analisar a importância do acompanhante durante todo o trabalho de parto, avaliar o motivo que levam as unidades de saúde em negar a presença do acompanhante, estudar a lei 11.108 sobre o prisma da bioética e seus efeitos e por fim, observar se o judiciário vem resguardando esse direito às parturientes.
